The doctoral thesis: “Improving the Law on the Organization and Operation of the Government to Meet the Requirements of Modern National Governance in Vietnam” of PhD candidate Nguyen Thi Thuc, major in Theory and History of State and Law, training course: K36 (2020-2024).

New academics theoretical and practical contributions: 

On the basis of studying and absorbing the rational elements of published works related to the issues, the thesis has developed and pointed out the conceptual meaning, identified characteristics, and analyzed the roles, content and requirements in order to improve the law on the orgnization and operation of the government to meet the requirements of modern national governance.

New findings and main results of the thesis:

Based on a systematic and in-depth analysis of the theoretical issues related to improving the legal framework governing the organization and operation of the Government to meet the requirements of modern national governance, this dissertation presents a comprehensive overview of the historical development and current state of the legal framework governing the organization and operation of the Government in Vietnam.

Moreover, the dissertation identifies 4 key perspectives on legal improvement, emphasizing the alignment with the Party’s viewpoint on a socialist rule of law and modern national governance. The dissertation proposes seven sets of solutions to improve the legal framework governing the organization and operation of the Government to meet the requirements of mordern national governance, including: (i) Enhancing awareness of mordern national governance and the role of improving the legal framework governing the organization and operation of the Government; (ii) Continuously improving the content of laws; (iii) Strenthening transparency and public participation in the development of laws governing the organization and operation of the Government; (iv) Innovating the process of developing and improving laws governing the organization and operation of the Government; (v) Enhancing the quality of appraisal and examination of the development and promulgation of laws governing the organization and operation of the Government; (vi) Improving the quality of human resources directly involved in developing and improving laws governing the organization and opreation of the Government; (vii) Ensuring adequate resources and material conditions. 

These solutions must be implêmnted simultaneously to meet the requirements of modern national governance and build a proactive and developmental Government in the new context.
